These Terms and Conditions set out the basis on which House Clearance Lambeth provides house clearance and waste collection services. By making a booking, confirming a quotation, or allowing our operatives to commence work at your premises, you agree to be bound by these Terms and Conditions.

If you do not agree with any part of these terms, you must not use our services. You are advised to read this document carefully before placing any booking for clearance or waste removal.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Client means the person, company, or organisation requesting our services.

Services means house clearance, waste collection, rubbish removal, and any related services provided by House Clearance Lambeth.

Premises means the property or location at which the Services are to be carried out.

Waste means any items, materials, or goods removed from the Premises as part of the Services, including domestic, commercial, garden, or bulky waste, unless otherwise specified.

Quotation means the price or estimate provided to the Client for the Services, whether given verbally, in writing, or electronically.

2. Scope of Services

House Clearance Lambeth provides house clearance, waste collection, rubbish removal, and associated services. The exact scope of the Services will be as agreed between the Client and us at the time of booking and as confirmed in the Quotation.

Unless expressly agreed otherwise, the Services include the loading, removal, and lawful disposal or recycling of agreed items from the Premises. The Services do not include specialist cleaning, repair work, disconnection of mains services such as gas or electricity, removal of hazardous materials, or structural alterations.

We reserve the right to refuse to remove any items that, in our reasonable opinion, are unsafe, unlawful to transport or dispose of, or fall outside the scope of normal house clearance and waste collection services.

3. Booking Process

3.1 Initial enquiry

The Client may contact us by telephone, email, or other communication method to request a Quotation for house clearance or waste collection. We may ask for details about the type and volume of waste, access to the Premises, and any special requirements.

3.2 Quotations

Quotations are based on the information provided by the Client. All Quotations are given in good faith but do not constitute a binding offer until accepted by the Client and confirmed by us. Quotations may be subject to change if the information provided is incomplete or inaccurate, or if the actual volume or nature of waste differs significantly from that described.

3.3 Accepting a booking

A booking is considered confirmed when the Client accepts the Quotation and we acknowledge that acceptance, either verbally or in writing, and provide a scheduled date and approximate time for the Services. We may also require certain client details, including name, contact information, service address, and payment method, before confirming a booking.

3.4 Access to premises

The Client must ensure that we have safe and reasonable access to the Premises on the agreed date and during the agreed time window. This includes arranging any necessary parking, entry permissions, or lift access. If access is restricted or unsafe and we are unable to complete the Services, cancellation or waiting charges may apply.

4. Pricing and Payment

4.1 Pricing basis

Our charges are normally based on the volume, weight, type of waste, and the labour required to complete the Services. Additional charges may apply for heavy items, difficult access, specialist handling, or items requiring special processing in accordance with waste regulations.

4.2 Estimates on site

Where the volume or nature of the waste cannot be reliably assessed in advance, our operatives may confirm or revise the Quotation on arrival, before starting work. If the Client does not accept any revised price, we will not be obliged to carry out the Services, and a call-out fee may be charged to cover our costs.

4.3 Payment terms

Unless otherwise agreed, payment is due on completion of the Services on the day of collection. We may accept cash, card, or bank transfer. For certain jobs, including large clearances, commercial work, or repeat services, we may require advance payment or a deposit prior to commencement.

4.4 Late or non-payment

If payment is not received when due, we reserve the right to charge interest on the overdue amount at the statutory rate, and to recover any reasonable costs incurred in pursuing payment. Title to any items cleared does not transfer to us until the full service charge is paid.

5. Cancellations, Postponements, and Waiting Time

5.1 Client cancellations

The Client may cancel or postpone a booking by giving us notice. If the Client cancels more than 24 hours before the agreed arrival time, no cancellation charge will normally apply. If the Client cancels within 24 hours, or fails to provide access when we arrive, we may charge a cancellation fee or a call-out charge to cover our time and costs.

5.2 Our right to cancel or reschedule

We reserve the right to cancel or reschedule a booking due to events beyond our reasonable control, including but not limited to vehicle breakdown, staff illness, adverse weather, or safety concerns at the Premises. In such cases we will make reasonable efforts to notify the Client as soon as possible and to agree a new date and time. We will not be liable for any losses arising from such cancellations or delays, provided we act reasonably.

5.3 Waiting time

If our operatives are unable to start work at the Premises at the agreed time due to lack of access, delays caused by the Client, or other circumstances beyond our control, we may charge a reasonable waiting fee, or treat the booking as cancelled and charge a cancellation fee.

6. Client Obligations

The Client is responsible for:

Providing accurate information about the quantity and nature of waste to be collected.

Ensuring that all items intended for removal are clearly identified, separated where necessary, and not mixed with items that the Client wishes to keep.

Ensuring safe and clear access to the Premises, including stairs, hallways, and external pathways.

Obtaining any necessary permissions from landlords, managing agents, neighbours, or local authorities for the removal of items or use of shared access areas.

Ensuring that children, pets, and other persons are kept away from operational areas while the Services are carried out.

If the Client fails to fulfil these obligations, we may be unable to complete all or part of the Services, and additional charges may apply.

7. Items We Cannot Remove

Our waste collection and house clearance services are subject to UK waste regulations and health and safety law. We cannot remove or transport certain items, including but not limited to:

Asbestos or asbestos-containing materials.

Clinical or medical waste, including sharps.

Pressurised gas cylinders or tanks, unless fully discharged and accepted by our disposal partners.

Chemicals, solvents, paints, oils, or other hazardous substances not accepted at standard waste facilities.

Explosives, firearms, ammunition, or illegal items.

If such items are discovered during the clearance, we may refuse to handle them and may need to adjust the price or terminate the Services for safety and compliance reasons.

8. Waste Handling and Environmental Compliance

We operate in accordance with applicable UK waste legislation and duty of care requirements. All waste collected as part of our house clearance and rubbish removal services will be transported to appropriately licensed facilities for recycling, recovery, or disposal, as far as reasonably practicable.

We may issue a waste transfer note or similar documentation where required by law or for commercial Clients. The Client agrees to cooperate with any reasonable requests for information needed to comply with waste regulations.

Once items have been removed from the Premises and loaded onto our vehicle, they become our responsibility and will be handled as waste or reusable goods at our discretion, except where law requires specific treatment. The Client acknowledges that items are unlikely to be recoverable after collection.

9. Liability and Limitations

9.1 Reasonable care

We will take reasonable care when carrying out house clearance and waste collection to avoid damage to the Premises. However, the Client acknowledges that the movement of heavy or bulky items, especially in confined spaces, carries an inherent risk of minor damage such as scuffs or marks.

9.2 Exclusions of liability

We will not be liable for:

Pre-existing damage or defects at the Premises.

Wear and tear or damage that is reasonably expected from the removal of large or heavy items, provided we act with reasonable care.

Loss of or damage to any item that the Client intended to keep but did not clearly distinguish from waste before the Services commenced.

Any indirect, consequential, or economic loss, including loss of profit, loss of business, loss of opportunity, or loss of anticipated savings.

Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited or excluded under applicable law.

9.3 Maximum liability

Subject to the above, our total liability to the Client arising out of or in connection with the Services, whether in contract, tort, or otherwise, shall not exceed the total price paid or payable by the Client for the specific booking from which the claim arises.

10. Insurance

We maintain appropriate public liability insurance and, where applicable, employers liability insurance for the provision of house clearance and waste removal services. Details of our insurance cover are available on request.

11. Complaints and Service Issues

If the Client is dissatisfied with any aspect of our house clearance or waste collection service, they should contact us as soon as reasonably practicable, providing full details of the issue.

We will investigate complaints in a fair and timely manner and may request photographic evidence or access to the Premises to assess any alleged damage or incomplete work. Where a complaint is upheld, we may, at our discretion, offer to rectify the issue, provide a partial refund, or take other appropriate action.

12. Data Protection and Privacy

We collect and use personal information, such as contact details and service addresses, for the purposes of managing bookings, providing Services, issuing invoices, and fulfilling legal obligations.

We will take reasonable steps to keep personal data secure and will not sell or share it with unrelated third parties for marketing purposes. We may share necessary information with service partners, waste facilities, or regulatory authorities where required by law or for the performance of the Services.

13. Intellectual Property

All content, branding, and materials used in connection with House Clearance Lambeth, including text, images, and logos, remain our property or that of our licensors. Nothing in these Terms and Conditions grants the Client any rights to use our intellectual property except as necessary to receive the Services.

14. Amendments to Terms and Conditions

We may update or amend these Terms and Conditions from time to time to reflect changes in our services, legal requirements, or operational needs. The version in force at the time of the Clients booking will apply to that booking.

We recommend that Clients review these Terms and Conditions periodically if they make regular use of our house clearance and waste collection services.

15. Severability

If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful, or unenforceable, that provision shall be severed from the remaining provisions, which will continue to be valid and enforceable.

16. No Waiver

Any failure or delay by us in exercising any right or remedy under these Terms and Conditions shall not constitute a waiver of that or any other right or remedy. Any single or partial exercise of a right or remedy shall not prevent further exercise of that or any other right or remedy.

17. Third Party Rights

These Terms and Conditions are between House Clearance Lambeth and the Client. No other person shall have any rights to enforce any of its terms under the Contracts Rights of Third Parties Act 1999 or otherwise.

18. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the law of England and Wales.

The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

By proceeding with a booking for house clearance or waste collection with House Clearance Lambeth, the Client confirms that they have read, understood, and agreed to these Terms and Conditions.
